The last action is the seminar that the CIPB organized from 05 to 07 January 2022 in collaboration with the Directorate General of Taxes (DGI), a seminar on the theme: &#8220;which tax reforms to increase the competitiveness of companies&#8221;. In this interview, Roland Riboux, President of the CIPB discusses the reforms implemented to further improve the business climate in Benin and for sustainable and inclusive development.<\/p>\n<p>Benin Economist: Hello Mr. President, introduce us to the National Council of Private Investors in Benin.<\/p>\n<p>Roland Riboux, President of the CIPB: The Council of Private Investors in Benin (CIPB) is an association founded in December 2002 by a group of entrepreneurs who have invested significantly in Benin, all aware of the need to apply themselves more in the future of the country where they are settled. It now brings together some fifty large companies that have decided to combine their experience, skills and economic weight to influence the environment in which they operate in a concerted way. The CIPB brings together all trades and all sectors of activity. Devoid of any political ambition, he defends a long-term vision of the company, a creator of wealth, an essential vector of growth, jobs and poverty reduction. A circle of reflection, exchange, analysis and proposals, the CIPB is a recognized interlocutor of national decision-making bodies on issues of economic, fiscal and social orientations in Benin. The objectives of the CIPB are closely related to the activity and concerns of the members as well as the business environment in Benin. These are the promotion of good governance, the adaptation of human resources to the world of work; tax reform with a focus on the informal sector; justice reform; optimization of local resources; bring to the State the vision of the private sector to promote a space favorable to investment and employment.<\/p>\n<p>What does the CIPB concretely do to improve the business climate in Benin?<\/p>\n<p>The CIPB has carried out many actions since its creation to improve the business climate. For example, in matters of commercial justice, the assessors who no longer existed in the courts, we worked to revive the legal system of assessors. We have taken the necessary steps to ensure that the assessors are appointed by the unions and by the employers. The most important thing is that in 2016, we created a consultation framework and at the same time we lobbied intensely with regard to the National Assembly to achieve the demarcation between rights and interest for damages in respect of so-called unfair dismissal. This was introduced in Parliament during the last term of President Yayi Boni, but implemented by President Patrice Talon, who incidentally added measures to make employment contracts more flexible. Afterwards, we mainly supported the Cotonou Commercial Court which was created in December 2017. Then, our cooperation took the form of three annual seminars which were held at the end of each year, 2019, 2020 and 2021.<\/p>\n<p>The first seminar mainly concerned the Commercial Court of Cotonou and focused on: &#8220;What tax reforms to increase the competitiveness of companies?&#8221;. The second focused on &#8220;the collection of bank debts and the realization of real estate securities&#8221;. The third focused on &#8220;the protection of the commercial lease against non-payment of rents and the realization of real estate guarantees&#8221;.<\/p>\n<p>Mr. President, what about the public-private partnership?<\/p>\n<p>The public-private sector partnership is at the heart of CIPB&#8217;s efforts. Since, essentially, we reflect on a subject and then we strive to bring it to the attention of the authorities most often through the Chamber of Commerce and Industry of Benin and the National Council of Employers of Benin. And if you look closely, we have created a consultation framework on taxation which brings together all the entities of the private sector, the orders, the Chamber of Commerce and Industry of Benin, employers with the aim of maintaining a dialogue with the public sector through the consultation framework. The same thing has been done in the area of commercial justice, where a consultation framework has been set up with the Ministry of Justice. As the minister is present, including most of the important members of the ministry and all the magistrates who are there, this effectively makes it possible to have a real partnership. Our goal is for the partnership to extend to other subjects since we believe that we can bring a lot for the public sector, our point of view being useful on different subjects. Let&#8217;s give a few examples: on trade, it is important for health control, it is important to avoid unfair competition between quality products from Benin and those imported of poor quality. We want to develop dialogue on important topics such as energy, digital technology and professional training. For us, the public-private partnership is something fundamental.<\/p>\n<p>A new General Tax Code has been adopted, the content of which you are aware of. What observations does the CIPB make on the new Tax Code?<\/p>\n<p>This was expected since the old code was a compilation made by adding finance laws with articles that sometimes overlapped or even contradicted each other. We have a brand new code where there are no more contradictions.
